FAMILY PETITIONS (I-130)

This page contains Instructions for filing an I-130 with the USCIS Vienna Field Office.

I-130 PETITION FOR ALIEN RELATIVE

The USCIS Vienna Field Office accepts I-130 petitions only in person from U.S. citizens who reside permanently in Austria. U.S. citizens whose principal residence is not in Austria, and/or are abroad temporarily as a visitor or on business, must file the petition in the United States. If you are not eligible to file in Austria, you should file the petition with the Chicago Lockbox. Lawful Permanent Residents must file the petition in the United States.

EVIDENCE OF RESIDENCE

The prospective U.S. citizen petitioner has to provide evidence that he/she has been permanently residing in Austria for at least six months prior to the filing of the application. Proof may include Austrian residence permit and/or police registration ("Meldezettel").

APPOINTMENTS

The application has to be filed in person by the U.S. citizen petitioner. Mail filing cannot be accepted.

    Original documents are copied and returned to the petitioner immediately. Note that translations of documents do not need to be notarized.
